AN ORDI NANCE TO REZONE FROM R-2 TO R-3 0.13 ACRES MORE OR
LESS ON PREMISES KNOWN AS THE 10500 BLOCK OF CEDAR AVENUE,
AND SHOWN ON CITY TAX MAP 57-2-((2)) AS PARCELS 108 AND 109,
AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF
THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA.

WHEREAS, Laurick Development Corporation, owner, has heretofore
filed with this Council a written application to have rezoned from R-2 to R-3
0.13 acres more or less in the 10500 block of Cedar Avenue and shown on City
tax map 57-2-((2)) as parcels 108 and 109, described as follows:
"Beginning at a point on the Northerly line of Cedar Avenue, said
point being S86°56'30"W, 111.46 feet from the Southwesterly corner of
Thomas Stanton Berkey as acquired in Deed Book 3140 at Page 446 among
the land records of Fairfax County; thence with the said line of Cedar
Avenue S88°19'19'~, 88.82 feet to a point on the Easterly side of a
25-foot street; thence with the said side of the street N08°24'04'~,
65.99 feet to a point; thence departing the said street and running
through the property of Laurick Development Corp. N88°19'19"E, 88.91
feet and S08°19'24"E, 65.98 feet to the point of beginning. Con-
taining 0.13 acres.
WHEREAS, the said application, having been found by this Council to
be in proper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the filing
thereof, was promptly referred to the Planning Commission of this City for its
investigation and recommendations thereon, and was duly advertised for public
hearing before the Planning Commission in the manner and for the time required
by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of
the Code of Virginia of 1950, as amended, and was heard by the Planning Commis-
sion in public hearing pursuant to such advertisement, and was duly advertised
for public hearing thereon before this Council in the manner and for the time
required by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, and
WHEREAS, said public hearing on said application has been this day
held, and said City has considered the recommendations of said City Planning
Commission, duly filed, and the evidence presented in connection with said
application at the public hearing, and has reached its decision on said
application,

NOW THEREFORE, BE IT ORDAINED that said application be and the
same hereby is granted, and that the aforesaid land hereinbefore and in said
application more specifically described be and hereby is rezoned from R-2 to
R-3 zone, as set forth and defined in the said Zoning Ordinance and amendments
thereto, subject to the use regulations permitted in such R-3 zone, and that
the Zoning Administrator of the City be and he hereby is directed to correct
the Zoning Map heretofore adopted as a part of the Zoning Ordinance to
properly show such change in the zoning of said land, and that the Clerk of
this Council be and she now hereby is directed to transmit duly certified
copies of this ordinance to the applicant, Zoning Administrator and to the
Planning Commission of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
