19700106 1970-1 ORDINANCE NO. 1970-1 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, TO ALLOW THE CITY TO REMOVE OR REPAIR UNSAFE STRUCTURES AND TO CHARGE THE EXPENSES THEREOF AGAINST THE OWNERS OF SUCH PROPERTY · WHEREAS certain unsafe structures exist in the City of Fairfax, Virginia, posing a problem to the health, safety and general welfare of the citizens of the City of Fairfax, Virginia and others; and WHEREAS the owners of said structures cannot be located or refuse to correct such conditions; and WHEREAS it is essential that such conditions be corrected immediately and the cost thereof be charged against the owners of such properties; and WHEREAS these conditions constitute an emergency requir- ing immediate action by the City Council of the City of Fairfax, Virginia; NOW, therefore, be it ORDAINED by the City Council of the City of Fairfax, Virginia, that the Code of the City of Fairfax, Virginia, be amended by adding a new section, Sec. No. 5-6, reading in its entirety as follows: "Sec. No. 5-6. Unsafe Buildings. Section 125.0 of the Building Code adopted by Section 5-1 shall be amended by adding the following new sections which shall read in their entirety as follows: 125.7--Upon refusal or neglect to comply with the requirements of the order to abate the unsafe condition by the person who has been either served with an unsafe notice or been given notice equiva- lent to service, the City of Fairfax through its own agents or employees may remove, repair or secure any 1970-1 -2- building, wall or any other structure which might endanger the public health or safety of other resi- dents of the City, wherein the owner of such property after reasonable notice and a reasonable time to do so, has failed to remove, repair or secure such building, wall or other structure. 125.8--In the event the City of Fairfax through its own agents or employees removes, repairs or secures any building, wall or any other structure after complying with the notice provisions of this section, the cost or expenses thereof shall be chargeable to and paid by the owners of such pro- perty and may be collected by the City of Fairfax as taxes and levies are collected. 125.9--Every charge authorized by this section with which the owner of any such property shall have been assessed and which remains unpaid shall consti- tute a lien against such property." An emergency existing, this ordinance shall take effect immediately upon its passage at the same meeting at which it is introduced pursuant to Section 5.6 (e) of the Charter of the City of Fairfax, Virginia.
