AN ORDINANCE TO REZONE FROH C-2 TO C-3 i,269 SQUARE
FEET OF LOT i-B OF EAST FAll{FAX PARK ON PREHISES KNOWN
AS 9596 LEE HIGHWAY AND TO ACCORDINGLY CORRECT THE ZON-
ING HAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE
CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-555-70-
2.)
WHEREAS, Gulf Oil Corporation, owners, has heretofore filed
with this Council a written application to have rezoned from C-2 to C-3
1,269 square feet that is not presently zoned C-3 on premises known as
9596 Lee Highway, described as follows:
"Beginning at the southwest corner of Lot l-A, East Fairfax
Park in the east line of Circle Center, Inc.; thence with the south line
of said Lot l-A, N 70° 25' 40" E, 9.50 feet to a point; thence departing
the said south line of Lot 1-A and through Lot l-B, S 60° 51' 50" W, 9.79
feet to a point in the east line of Circle Center, Inc.; thence with the
said east line of Circle Center, Inc., N 14° 13' 20" W, 1.63 feet to the
beginning and containing 8 square feet."
"Beginning at the southern corner of Lot i-A, East Fairfax
Park in the north line of Lee Highway; thence through said Lot i-B, N
27° 26' 40" W, 158.13 feet to a point in the common boundary of Lots 1-A
and I-B, East Fairfax Park; thence with the said common boundary of Lots
]-A and l-B, East Fairfax Park N 70° 25' 40" E, 15.96 feet to the north-
east corner of Lot l-B, east Fairfax Park; thence con~.~nuing with the
common boundary between Lot I-A and i-B, East Fairfax Park, S 21° 42' 30"
E, 158.13 feet to the beginning and containing 1,261 square feet."
WHEREAS, the said application, having been found by this
Council to be in p~oper form and accompanied by the required map or
blueprint and the receipt showing payment of the fee required to be paid
at the time of the filing thereof, was promptly referred to the Planning
Commission of this City for its investigation and recommendations thereon,
and was duly advertised for public hearing before the Planning Commission
in the manner and for the time required by the Zoning Ordinance of this
City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950,
as amended, was heard by the Planning Commission in public hearing pursuant
to such advertisement, and was duly advertised for public hearing thereon
before this Council in the manner and for the time required by the Zoning
Ordinance of this City, as amended, and by Section 15.1-493 of the Code
of Virginia of 1950, as amended; and
WHEREAS, said public hearing on said application has been this
day held, and said City has considered the recommendations of said City
Planning Commission, duly filed, and the evidence presented in connection

with said application at the public hearing, and has reached its decision
on said application,
NOW THEREFORE, BE IT ORDAINED that the said application be, and
the same hereby is granted, and that the aforesaid land hereinbefore and
in said application more specifically described be, and hereby is rezoned
from C-2 to C-3 Zone, as set forth and defined in the said Zoning Ordinance
and amendments thereto, subject to the use regulations permitted in such
C-2 Zone, and that the Zoning Administrator of the City be, and he hereby
is directed to correct the Zoning Map heretofore adopted as a part of the
Zoning Ordinance to properly show such change in the zoning of said land,
and that the Clerk of this Council be, and she now hereby is, directed to
transmit duly certified copies of this ordinance to the applicant, Zoning
Administrator and to the Planning Commission of this City as soon as
possible.
This ordinance shall take effect immediately upon its passage
by the City Council of the City of Fairfax, Virginia.
