19700616 1970-161970- 16 ORDINANCE NO. ]970-16 AN ORDINANCE TO REZONE FROM C-2 to I-2 16,546 SQUARE FEET MORE OR LESS CONTAINED BY LOT5 22 AND 23, EAST FAIRFAX PARK, ON PREMISES KNOWN AS 3165 CAMPBELL DRIVE AND TO ACCORDINGLY CORRECT THE ZONING HAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX~ VIRGINIA. (APPLICATION NO. Z-558-70-].) WHEREAS, James C. Edwards and Herbert G. Risse, contract owners, have heretofore filed with this Council a written application to have rezoned from C-2 to I-2 ]6,546 square feet contained by Lots 22 and 23, East Fairfax Park, on premises known as 3165 Campbell Drive, described as follows: ~Beginnin9 at a point lying on the easterly side of Campbell Drive, (50 foot wide (formerly Oak Street)) and lies 208.98 feet from the original northerly side of Lee Boulevard; thence running with said easterly side of Campbell Drive N 09° 45~ O0~ E ]20.00 feet to a point being the southwesterly corner of Lot 24, East Fairfax Park; thence de- parting said Campbell Drive and runnin9 with the southerly line of said Lot 24 S 80° ]5~ O0~ E ]37.89 feet to a point being a corner common to Lots 14, ]5, 23, and 24; thence running with the westerly lines of Lots ]5 and ]6, S 09° 45~ O0~ W ]20 feet to a point being a corner common to Lots 16 and 22 and lying in the northerly line of a lot now or for- mer]y in the name of the Vienna Development Corporation; thence depart- ing said Lot ]6 and running with the northerly line of said Vienna Development Corporation lot N 80° ]5~ O0~ W ]37.89 feet to the point and place of beginning and containing ]6,546 square feet of ]and, more or less.~ WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommenda- tions thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section ]5.]-493 of the Code of Virginia of ]950, as amended; and WHEREAS, said public hearing on said application has been this day he]d, and said City has considered the recommendations of said City 1970-16 Planning Commission, duly filed, and the evidence presented in connec- tion with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is granted, and that the aforesaid land hereinbefore and in said application more specifically described be, and hereby is, rezoned from C-2 to I-2 Zone, as set forth and defined in the said Zon- ing Ordinance and amendments thereto, subject to the use regulations permitted in such I-2 Zone, and that the Zoning Administrator of the City be, and he hereby is, directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is, directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible.
