ORDINANCE NO. 1970-21 AN ORDINANCE TO REZONE FROM C-2 AND I-2 TO C-3 22,000 SQUARE FEET, BEING PART OF LOT 2 OF A SUBDIVISION OF THE LANDS OF PRESTON BUILDING CORPORATION, ET AL, ON PREMISES KNOWN AS 3215 OLD LEE HIGHWAY, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-560-70-2.) WHEREAS, Lucky Stores, Incorporated, owner, has heretofore filed with this Council a written application to have rezoned from C-2 and I-2 to C-3 22,000 square feet being part of Lot 2 of a subdivision of the lands of Preston Building Corporation, et al, on premises known as 3215 Old Lee Highway, described as follows: "BEGINNING for the same at a point in the northeast corner of the parcel herein described, said point being distant South 10© 59' 00" East 18.76 feet and South 79© 01' 00" West 35.00 feet from the northeast corner of Lot 2, and running thence within Lot 2 the following eight courses and distances: 1. South 10© 59 2. South 79© 01 3. North 10© 59 4. South 79© 01 5. North 10© 59 6. North 79© 01 00" East 115.63 feet to a point; 00" West 147.00 feet to a point; 00" West 55.00 feet to a point; 00" West 20.00 feet to a point; 00" West 108.00 feet to a point; 00" East 80.00 feet to a point distant South 21© 05' 20" West 40.54 feet from the southwest property line of Pickett Road; 7. South 10© 59' 00" East 47.37 feet to a point; 8. North 79© 01' 00" East 87.00 feet to the place of beginning, containing 22,000 square feet of land." WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the 1970-21 -2 Planning Commission of this City for its investigation and recommenda- tions thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the zoning Ordinance of this city, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the zoning Ordinance of this city, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended; and WHEREAS, said public hearing on said application has been this day held, and said City has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is granted, and that the aforesaid land herein- before and in said application more specifically described be, and hereby is, rezoned from C-2 and I-2 to C-3, as set forth and defined in the said zoning Ordinance and amendments thereto, subject to the use regulations permitted in such C-3 Zone, and that the zoning Administrator of the city be, and he hereby is, directed to correct the Zoning Map heretofore adopted as a part of the zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is, directed to transmit duly certified copies of this ordinance to the applicant, zoning Administrator and to the Planning Commission of this city as soon as possible. 1971-21 -3 This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia.
