19661115 1996-13ORDINANCE NO. 1966-13 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF CERTAIN PROVISIONS OF SECTION 4 OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. THE CITY COUNCIL OF THE CITY OF FAIRFAX HEREBY ORDAINS: That Section 4 of the Zoning Ordinance of the City of Fairfax, Virginia, is hereby amended as follows: 1. Substitute for the present Subsection 4.01, the following: 4.01 INTENT: It is the intent of the section that non- conforming uses are inconsistent with the purpose of this Chapter, that they are recognized and per- mitted to continue only because they are antecedent to the ordinance, that they be restricted closely, and that although they may be continued, they shall not be enlarged or extended. 2.In Subsection 4.02, substitute the phrase "of two years" for "exceeding 180 days". 3.Add the following subsection after the present 4.05: 4.06 An enlargement, extension, reconstruction or structural alteration of a non-conforming use in a Commercial-2 zone may be authorized by special use permit issued by the Board of Zoning Appeals, subject to such con- ditions, bonds, and guarantees as the Board may deem necessary in the public interest, provided that such use is permitted in another commercial zone and, provided further that the use for which an extension or enlargement is sought conforms to the minimum lot requirement in the zone where it is permitted and, after construction of the extension or enlargement proposed, the entire structure or structures will adoption. meet all other requirements for such a use in the zone where it is permitted including those governing side, rear and front setbacks.
