19661220 1996-21ORDINANCE NO. 1966-21 CITY OF FAIRFAX VIRGINIA ORDINANCE NO. 1966-21 An Ordinance to repeal chapter 16 of the Fairfax City Code and enact in its place a new chapter entitled "Plumbing", adopting the Washington Metropolitan Area Plumbing Code, 1966 edition, with amendments thereto; establishing and defining the powers and duties of a board of plumbing examiners; providing for the examination and regulation of master plumbers, Journeyman plumbers and plumbing, contractors; providing for certificates of registration for master plumbers, Journeyman plumbers and plumbing contractors; providing for plumbing permits and fees; providing :for inspection of plumbing work; and providing other rules and regulations for plumbing work within the City of Fairfax, Virginia. Be it ordained by the City Council of the City of Fairfax: Section One. Chapter 16 of the Fairfax City Code is hereby repealed, and a new chapter numbered 16, entitled "Plumbing", is hereby enacted to read as follows: 16-1 through 16-9. 16-10 through 16-13 16-14 through 16-22 16-23 through 16-27 Article I. DEFINITIONS 16-1 Unless otherwise expressly stated or the context clearly indicates a different intention, the following terms shall, for the purpose of this chapter, have the meaning respectively ascribed to them in this section: PLUMBING WORK. The installation, alteration, repairing, servicing, and maintenance of plumbing and gas equipment. PLUMBING CONTRACTOR. A person, firm, partnership or corporation, that either in person or by the employment of master [)lumber and journeyman, for a fixed price, commission, fee or percentage, undertakes to bid upon or accept, or offers to accept, orders or contracts for performing or superintending plumbing or gas work. MASTER PLUMBER. A p~rson qualified under the provisions of this chapter to perform or supervise the performance of plumbing or gas work for hire. JOURNEYMAN PLUMBER. A person doing any plumbing or gas fitting work for hire under the direct supervision of a master plumber or master gas fitter. INSPECTION. The scrutiny and checking of a plumbing or gas installation to determine whether or not the installation has been in conformity with the State and Local~ laws governing plumbing and gas installation and materials. 16-2 ADMINISTRATION. The administration and enforcement of this chapter shall be the duty of the Plumbing Inspector (under the supervision of the Director of Public Works) who is hereby authorized to take such action as may be reasonably necessary to enforce the provisions of this chapter. Such person or persons may be appointed and authorized as assistants or agents of such admin- istrative authority as may be necessary to carry out the provisions of this chapter. INSPECT I ON 16-3 INSPECTION. It shall be the duty of the Plumbing Inspector to inspect all plumbing in the course of construction, alteration or repair, to make pre- scribed tests, and generally see that the provisions of this ch'apter are duly carried out and observed. 16-4 The Plumbing Inspector shall keep suitable records of permits, inspections, tests, complaints and all matters coming under his jurisdiction as provided in this chapter, and shall make reports as directed. AUTHOR ITY 16-5 AUTHORITY. The Plumbing Inspector shall have full autr~ority, to do any and all things necessary to carry into effec: all provisions of this chapter, and may condemn plumbing work not executed in accordance therewith, or plumbing fixtures, fittings, appliances and materials not complying with the requirements thereof. He shall have the right of entry to any premises during reasonable hours to inspect plumbing when in course of construction, alteration or repair; or to inspect plumbing in places which may be complained of by an interested citizen in writing. Pg. 2 He or any officer of the law shall stop any work of excavation for plumbing purposes or any plumbing work under way for which no permit has been issued or which is not proceeding in accordance with the terms of a permit issued therefor. LIABILITY FOR DAHAGES 16-6 Nothing in this chapter shall be construed to relieve from or lessen the responsibility or liability of any party owning, operating, controlling or installing any plumbing or gas piping, appliances, or equipment for damages to person or property caused by any defect therein, or to hold the City of Fairfax as assuming any such responsibility or liability by reason of the inspection authorized herein or the certificate of approval issued as herein provided. ZONING AND SRNITATION ORDINANCES UNAFFECTED 16-7 Nothing in this chapter or in the code hereby adopted shall be held to affect the City Zoning Ordinance or Chapter 19 of this Code, 16-8 Any defects in plumbing work, fixtures or appliances shall be corrected within ten days after receipt of notice in writing of such defects from the plumbing inspector. Each day after such ten day period that such defect shall remain uncorrected shall constitute a separate offense. 16-9 The Board of Plumbing Examiners shall make such ru;e~ and regulations in furtherance of the purposes of this chapter and as are not inconsistent with the specific provisions of this chapter for the installation, repair or alteration of air conditioning systems, water treatment equipment and water operated devices as may be deemed necessary to properly protect the water supply system and sewage system. BOARD OF PLUMBING EXAMINERS 16-10 ESTABLISHMENT OF BOARD. There is hereby established a Board of Plumb- ing Examiners (hereinafter referred to as the board) to consist of not fewer than four members. One member shall represent the department of health, one member shall be a master plumber, one member shall represent the public and one member shall be the plumbing inspector who shall act as chairman. The members of the board shall be appointed by the City Council and shall serve without compensation. 16-11 MEETINGS. The board shall hold its first meeting not less than thirty days following its appointment. Thereafter, the board shall meet a~ such intervals as may be necessary for the proper perfOrmance of its duties, but in any case not less than twice a year. 16-12 EXAMINATION AND CERTIFICATION. The board shall establish standards and procedures for the qualification and examination of master p]~.~mbers, master gas fitters and journeyman plumbers and shall issue an appropriate certificate to each person who meets the qualifications therefor and successfully passes the examination given by the board. The board shall keep an official record of all its transactions. 16-13 RE-EXAMINATION. Any person who fails to pass an examination as prescribed by the board may apply for re-examination after the expiration of thirty days upon payment of the regular examination fee., Pg. 3 16-14 CERTIFICATES OF REGISTRATION. Four forms of certificates, shall~ be issued. The first shall be known as "Master Plumber's Certificate", and the second, as "Journeyman Plumber's Certificate", the third, as "Master Gas Fitter's Certificate". There shall also be a fourth form ~hich shall be known as "Plumbing Contractor's Certificate". 16-15 JOURNEYMAN AND MASTER PLUMBER'S LICENSE. No person shall enter into~ engage in or work at the business of plumbing or gas fitting, unless such person' shall have received a certificate of registration, as a master plumber or journey- man, issued by the Board of Plumbing Examiners in accordance with the provisions of this chapter. 16-16 MASTER PLUMBER'S OR GAS FITTER'S CERTIFICATE. a. Applicants for Master Plumber's or Master Gas Fitter's Certificate shall be at least twenty-one (21) years of age. They shall be examined on their knowledge of the trades of plumbing or gas fitting, their knowledge of regulations governing plumbing or gas fitting work in the City, and their ability to lay out and supervise plumbing and gas work. They shall demonstrate to the satisfaction of the Board of Plumbing Examiners their fitness properly and iintelligently to barry on the business of Master Plumber or Master Gas Fitter. Applicants for Master Plumber's or Master Gas Fitter's Certificates must have had at least four (4) years experience as a journeyman apprentice plumber or gas fitter, or in lieu thereof, shall be a graduate in Plumbing Engineering of a College or University with one year practical plumbing or gas fitting experience. An applicant shall make a written application for examination. In case of 'failure, the applicant shall be eligible for re-examination one month after failure, but if he fails at such re- examination, then he shall be ineligible for further examination until a further lapse of six (6) months. b. An applicant for Master Plumber or Gas Fitter's certificate who has passed the required examination shall be eligible to receive such certificate, issued by the Board of Plumbing Examiners, provided he has paid $15.00 for Master Plumber's and $10.00 for Master Gas Fitter's, at the time of the examination for the first year, and upon payment of $7.50 for Master Plumber and $I0.00 for Master Gas Fitter, for each renewal prior to the expiration date of the certificate. c. The Board of Plumbing Examiners shall furnish the holders of a Master Plumber's or Master Gas Fitter's Certificate of r.egistration with an identification card which shall be carried on the person or such holders and exhibited on request. d. Holders of a Master Plumber or Master Gas Fitter's Certificate of registration shall not engage in the business of Plumbing Contractor and work as a Master Plumber or Master Gas Fitter for another Plumbing Contractor at the same tithe. 16-17 JOURNEYMAN PLUMBER'S CERTIFICATE. a. Applicant for Journeyman Plumber's Certificate must be ac least eighteen years of age and have had at least three years experience as an apprentice or helper. An applicant shall make written application for examination. In case of failure the applicant shall be eligible for re-examination one month after failure, but if he fails at such re-examination then he shall be ineligible for examination until a further lapse of six (6) months. Pg. ~ b. An applicant for a Journeyman Plumber's Certificate who ha~ passed the required examination shall be eligible to receive such certificat~ issued by the Board of Plumbing Examiners, provided he has paid 52.00 at the time of the examination for the first year, and upon payment of 52.00 for each renewal prior to the expiration date of the certificate. c. The Board of Plumbing Examiners shall furnish the holders of a Journeyman Plumber's Certificate of registration with an identification card which shall be c~rried on the person of such holders and exhibited on request. 16-18 PLUMBING CONTRACTOR'S CERTIFICATE. No individual, firm, partnership or corporation shall engage as a Plumbing Contractor in t~e installation, maintenance, repairing, servicing or altering of plumbing or gas equipment in or on any building structure or part thereof or on premises within the City, without first having applied for and been issued a certificate of registration by the Board of Plumbing Examiners in accordance with the provisions of this chapter. , 16-19 PLUMBING CONTRACTOR'S CERTIFICATE. a. 'MASTER PLUMBER REQUIRED. A firm, partnership or corporation may apply for and receive a Plumbing Contractores Certificate provided e bona fide member, officer or authorized agent of the firm, partnership or corporation, passes the required Master Plumber's examination; and further provided that all plumblng work done by such firm, partnership or corporation shall be executed by or be under the In~nedlate supervision of such Master Plumber. In the event the Master Plumber severs his assoclatloq with or employment by such flrm, partne~shlp or corporation, the Plumbing Contractor's certificate shall Immediately become void, but may be reinstated without charge, wlthln the valid period, upon the employment of another registered Master Plumber. b. BOND PREREQUISITE TO PLUMBING CONTRACTOR'S CERTIFICATE OF REGISTRATION. Before any Plumbing Contractor's Certificate shall be Issued the applicant therefor shall furnish a bond payable to the City of Fairfax in the sum of one thousand dollars ($1,OOO.OO) with surety approved by the City of Falrfax and conditloned to indemnlfy and save harmless the City, as well as any other person, from all expense and damage that may be caused by any negligent, defective or Inadequate work done in the City under his certificate. Vhen any plumbing work has been done by a Plumblng Contractor, which shall be considered defectlve or inadequate by the Plumblng Inspector and the Contractor shall fail to revise or put such work in proper condition to the satisfaction of the Plumbing Inspector within ten (IO) days al:er written notlce from the Plumbing Inspector to do so, the bond sh~ll be for- feb:ed and the principal and surety on such bond shall ipso facto be and become l:~,e for, and shall pay so much on account of such bond as may be necessary to perfect such ~ork and, In addition thereto, shall pay any and ali damages which may be occasloned to any person by reason of such defective or inadequat~ work. Thls bond shall be deposited with the Bureau of Inspections. c. FEE. Applicants for Plumbing Contractor's Certificate who have complied wlth the applicable provisions of thls Ordinance shall be ellgib~e :o receive such certlflcate upon the payment of 515.O0 for the first year and $7.50 for each renewal, provided the renewal fee Is paid before the explratlon date of the certificate. d. DISPLAY OF PLUMBING CONTRACTOR'S CERTIFICATE. The holder of a Plumbing Contractores Certlflcate of Reglstration shall keep such ~ertlficate displayed In a consplcuous place In his principal office or place of business. e. Holders of a Plumbing Contractor's Certificate contracting work costing 520,000.00 or more shall comply wlth the requirements of the Virginia State Registra- tion Board for Contractors, as referred to in Chapter 7 of Title 5~ of the Code of Pg. 5 16-20 RENEWAL OF CERTIFICATES OF REGISTRATION. Certificates of Registration shall be issued for one year commencing on danuary First of each year. Certificates of Registration shall be renewed on or before January First of each year there- after. Master Plumber's and Master Gas Fitter's shall be required to appear in person for renewal of their license. Anyone failing to renew his Master Plumber's, Master Gas Fitter's or Journeyman Plumber's Certificate of Registration on or before February First of any year must be re-examined before a new certificate of registration can be issued. Any Master Plumber, Master Gas Fitter or dourneyman Plumber whose Certificate of Registration expires while the holder thereof is in the military or naval service of the United States shall be renewed without further' examination, upon payments of the prescribed fee, at any time within six (6) mohths after such person is discharged from the service. 16-21 REVOCATION. The board may revoke any certificate if Obtained through nondisclosure, misstatement or misrepresentation of a material fact, or if a penalty has been imposed upon the certificate under this chapter. Before a certificate may be revoked, the Certificate holder shall have notice in writing, enumerating the charges against him, and be entitled to a hearing by the board not sooner than five (5) days from receipt of the notice. The certificate holder shall be given an opportunity to present testimony, oral or written, and shall have the right of cross-examination. All testimony shall be given under oath. The board shall have the power to administer oaths, issue subpeonas, and compel the attendance of witnesses. The decision of the board shall be based upon the evidence produced at the hearing and made part of the record thereof. A person whose certificate has been revoked shall not be permitted to re-apply for a certificate within one year from date of revocation. It shall be unlawful for him to enter into, engage in or work at the business of installing, altering, repairing, servicing, or maintaining plumbing or gas equipment during the period for which his certificate of registration is revoked or suspended. 16-22 EMPLOYMENT OF LEARNERS OR APPRENTICES. Nothing in this chapter shall be construed to prohibit the employment of a learner or apprentice working with and under the direct supervision of a holder of a journeyman plumber's certificate or a master plumber's or master gas fitter's certificate. PERMITS AND INSPECTIONS 16-23 REQUIREMENT FOR PERMIT. Unless excepted in this Section no plumbing or gas appliances or equipment shall be installed within or on any building, structure, premises, nor shall any alteration or addition be made in any such existing plumbing or gas appliances or equipment, without first having applied for and received a permit from the Plumbing'Inspector. 16-24 OWNERS PERMIT EXCEPTION. Any permit required by this chapter may be issued to any person to do any work requlated by this chapter in a single-family dwelling used exclusively for residence purposes, including the usual accessory buildings and quarters in connection with such building, provided that the person is the bona fide owner of such dwelling and that the same will be occupied by such owner and that such owner shall purchase ali material and perform all labor in connection herewith and comply with this chapter. Pg. 6 16-25 APPLICATION FOR PERMITS. Applications for a permit required by this chapter shall be on forms furnished by the Bureau of Inspections and shall contain the information as requested on the form. All applications for permits shall be signed by the Plumbing Contractor or his authorized agent except applications from bona fide owners of single-family dwellings. 16-26 PLANS AND SPECIFICATIONS. No permit required by this chapter shall ~e issued for any plumbing or gas work in or on any new commercial buildings, or for major plumbing or gas work in existing buildings, until the plans and specifications for the proposed work have been submitted to the Bureau of Inspections and it has been determined from such plans and specifications that the work conforms to the provisions of this chapter. If a permit is denied because of defective plans and specifications, the applicant may submit revised plans and specifications without payment of additional fee. If in the course of the work it is found necessary to make any change from the plans and specifications on which a permit has been issued, amended plans and specifications shall be submitted and a supplementary permit, subject to the same conditions applicable to original application for permit, shall be issued to cover the change. Repairs involving only the working parts of a faucet or valve, the clearance of stoppages, repairing of leaks or replacement o.f defective faucets or valves may be made without a permit, provided that no changes are made in the piping to the fixture. 16-27 PERMIT FEES. Fees in such amount as specified below shall be charged for the permits and inspections as required by this chapter. The prescribed fee shall be paid at the time the permit is issued and before any inspection shall be made by the Plumbing Inspector. a. Plumbing fees in any new buildings shall be $5.00, plus $1.00 for each fixture, including floor drain and water heaters. This fee also applies to putting complete new plumbing in existing unplumed buildings. b. Plumbing in additions, or remodeling, or changes in existing plumbing systems shall be $3.00, plus $0.75 for each fixture. c. Adding plumbing fixtures to an existing system without changes thereto shall be $3.00, plus $0.50 for each fixture. d. Water service shall be $3.00. e. Building sewer, new, replacement, or repair, shall be $5.00. f. Tapping public sewer or private sewer system shall be $5.00~ g. Additional inspections made necessary by undue delays in work~ the use of improper materials, failure to be ready for inspection when ordered, or failure to have system tight, each $3.00. h. Minimum fee charged for any permit~ $3.0'0. 16-28 There is hereby adopted for the purpose of establishing rules and regulations for safeguarding health, life and property by regulating and providing for the inspection of the installation, alteration, repairing, servicing and maintenance of plumbing and gas equipment; that certain Plumbing Code known as the Metropolitan Area Plumbing Code, 1966 Edition, except such portions as are herein deleted, modified, or amended, of which an official copy is on file in the Pg. 7 office of the Bureau of Inspections in the City Hall, Fairfax, Virginia, and may be viewed during the hours between 8:30 a.m. and 5:00 p.m., Monday through Friday, inclusive, except holidays, and the same is hereby adopted and incorporated as fully as if set out at length herein. - 16-29 (a) SANITARY DRAINAGE, VENT PIPING AND FITTINGS ABOVE GROUND WITHIN BUILDINGS. Sections 608 and 609 are hereby amended to include the use of Acrylonitrile- Butadiene-Stryene plastic pipe and fittings of not less ~than Schedule 40, here- inafter referred to as ABS, is approved for drainage, waste and vent (DWV) systems above ground in single-family dwellings of not more than two stories in height_ except that in split-level or like type of residences, the total vertical stack length shall not exceed twenty-four (24) feet from base of stack tb its terminal. "ABS, DWV pipe of not less than Schedule 40 is pipe conforming to Commercial Standards 270-65 and shall be plainly marked at intervals not greater than twenty- four (24) inches with the manufacturer's name or trade mark, pipe size, type of pipe, and symbol of applicable standard." 'The ABS, DWV fittings shall be marked with the manufacturer's name or trade mark, pipe size, type of pipe and symbol of applicable standard." 'The joint between pipe and fitting shall be solvent welded. Connections between ABS plastic pipe and pipe of other material shall be made with an approved type of adapter. Schedule 40 pipe shall not be threaded." (b) WATER SERVICE PIPE UNDERGROUND. Section 613 is amended to include the use of Polethlene (PE) pipe for water service only, provided the following Standards and Methods are used: 1. PE pipe shall be equal to or exceed Commercial Standard (CS) 255-63 160 PSI and shall bear the nsf seal of approval of the National Sanitation Foundation Testing Laboratory, Inc. 2. The water service pipe is to be one continuous length from meter to NOT more than 6" inside the building wall. 3. Two clamps each at terminate ends (meter and inside the building). Clamps, bolts and nuts shall be Yardley all stainless steel clamps # 688t~ 68816 or approved equal. Fittings shall be Yardley brass fittings; adapters #66703, 66753 or 90 degree ells #6630 or approved equals. Stress points of clamps shall be in opposite directions. 4. The pipe shall be laid on a firm base in a separate trenc~ from sewer or gas lines. If an area outside of the building wall has been excavated in such a manner that the pipe is NOT on solid base then a sleeve of heavy material (such as iron or steel pipe shall be used to encase the plastic pipe. Said sleeve shall extend from inside the building wall to a point three (3) feet beyond the excavation. It is not recommended that this type of pipe be bent but if necessary to bend the radius shall not be less than three (3) feet. 5. Markings on pipe shall face upward so as to plainly be seen by the Plumbing Inspector at time of inspection. Pg. 8 16-30 SANITARY AND STORM SEWERS. Where separate systems of sanitary drain- age and storm drainage are installed in the same property, the sanitary and storm building sewers or drains may be laid side by side in one trench. Rain water, surface water, ground water, subsurface water, cooling water or other similar discharge shall not enter the sanitary sewer directly or indirectly, except an areaway drain may be installed in an areaway having a floor area of not over twelve square feet and only rain water falling directly into the areaway may enter the sanitary sewer. Any of the above prohibited liquids found entering the sanitary sewer shall be removed. Connections for such liquids shall be sealed off or removed to prevent any further entrance of such liquids into the sanitary sewer. Basements leaking subsoil or surface water into the sanitary sewer shall be prohibited. 16-31 COMMERCIAL REFRIGERATION UNITS. Refrigeration units one ton or larger shall not discharge cooling water into the sanitary sewer. A drain from a cooling tower may discharge over a properly trapped and vented fixture, provided that such drain is for use in servicing unit and cannot bypass the cooling tower and discharge cooling water into the sanitary sewer. 16-32 OLD HOUSE SEWERS AND DRAINS. Old house sewers and house drains may be used in connection with new buildings or new plumbing and drainage work only when they are found, on examination and test, to conform in all respects to the requirements governing new house sewers, and the administrative authority shall notify the owner to make the changes necessary to conform to this chapter. 16-33 TAPPING PUBLIC SEWERS. All labor and material necessary for installing connections between boilding and street sewers, including those portions located within the rights of way of public or private streets, shall be furnished by the owners of such building at their cost and expense, all necessary work to be done by a registered plumber of the City. Connections to street sewers shall be made through existing Y branches previously installed or the connection shall be made by means of inserting an approved cast iron saddle in the street sewer and thoroughly cementing in place. Whenever it is necessary to tap the street sewer, the pipe shall be completely uncovered and the excavation shall be free of all water and shoring shall be installed if necessary. No street sewer shall be punctured for a tap or any other purpose except during the presence of and under the supervision of the Plumbing Inspector, and at least twenty-four hours notifi- cation of the date and hour when a tap is desired to be made shall be given the Plumbing Inspector. Before the tap can be made, the owner of the premis~ shall have made application for the connection to the Department of Public Works,.and paid all charges necessary for the connection. At the time the tap is made~ a section of the connection to be installed adjacent to the street sewer s~all be assembled and available for insertion into the saddle. Immediately after the saddle and the section of building sewer have been cemented in place~ the cement shall be covered with heavy paper and then covered to a depth of t~'o or more feet with dry dirt. The tap must be protected from water while the cement is green, and if the Plumbing Inspector directs, pumps must be used to keep water from the tap until the cement is hard. Test tees shall be located not closer than five feet nor more than twenty feet from the sewer saddle~ and between the test tee and saddle shall be extra heavy cast iron pipe. After the tap is made sewer must be completed and inspected in the shortest time possible, trenches must not be left open longer than a reasonable length of time to complete work and sewer shall be protected at all ti~es from damage by water and mud. Sufficient backfill shall be placed over pipe by hand to prevent damage when filling trench and that portion of the trench the street shall be tamped in twelve inch layers until full. Any additional requirement of the state highway department shall be carried out. Pg. 9 In subdlvlslons where the sanitary street sewer malns are being Installed by the developer, the developershallalso Install a spur or extension from the sanitary sewer main to one foot beyond the property line for each lot, this exo tentlon to receive the bulld|ng sewer for each lot. Such extensions are to be shown on the sewer plans submitted to and approved by'the Director of Public Works and the extensions are to be Installed in the exact location as shown on the plan. These spurs shall be constructed of extra heavy cast Iron soii pipe wlth lead and hemp joints, Including plug at end of spur, as specified in this chapter, except when attaching to cement or terracotta sewers the first joint attaching the spur to the sanitary sewer may be cemented. The spur shall enter The sanitary sewer through a Y placed In the sanitary sewer by the developer et the exact location for proper alignment with the spur. The spur shall be lald to the grades provided in this chapter. ' These spurs shall be Inspected and tested by the Plumbing Inspector along with and at the same time his Inspections ere being fnade for the installation o¢ the sanitary sewer. After a building Is connected through a spur to thc sanitary sewer the spur shall become a part of the bulldlng sewar and the ~vnar of the pram!sas sha~i be responsible for t'he operation and the maintenance o~ tho en~ra bu~ldlng s~.~r bet-~een the bulldlnq and the ~treet sewer, as set forth here|na~er ~h~s section. · 16-34 BROKEN SEWER MAIN~ In the event a section of the sewer main is broken during the process or'tapping, the plumber shall immediately r~place the broken section under the direction of the Plumbing Inspector and at the expense of the. plumber. 16-35 BUILDING SEWERS TO TRUNK LINES. Trunk lines may be tapped, but where available and with the approval of the Director of Public Works, building sewer may enter a trunk line manhole and a satisfactory bench and invert built, by and at the expense of the plumber, if no manhole is available, permission to construct a new manhole must be secured from the Director of Public Works and it must be built at the plumber's expense, under the direction of the Departmen~ of Public Works. 16-36 BUILDING SEWERS ENTERING MANHOLES. When permission is given Dy the Director of Public Works, house connections may enter a manhole on the top of the bench and a satisfactory invert shall be built by the plumber under the direction. of the Plumbing Inspector. The manhole shall be made watertight where the building sewer enters· The channel in the manhole for the entering bui~dlng sewer shall be made full s~ze of the pipe it.connects. It shall have a smooth rounded bottom. The benches shail be brought up to the fu~l height of the channel and drain toward the main channel. Channels shall curve toward the flow of the street sewer. -. 16-37 PROTECTION OF BUILDING SEWER. Where there is danger of surface water or mud enzering the building sewer, the pipe must be plugged. Taps are not to be made nor building sewers run until foundation walls are built. 16-38 OWNERSHIP OF BUILDING SEWER. The ownership of connections between build- ings and street sewers, including those portions located within the rights of way of pub~;¢ or private streets, shall be vested in the owners of such premises, and the City sna~i not be responsible for operation and maintenance of such connectlons. 16-3~ SIZE OF TAP PERMITTED. No eight inch sanitary sewer shall be tapped for a building sewer larger than five inches. SECTION TWO PENALT I ES Any person, firm, partnership or corporation who shall violate any of the provisions of this Ordinance, or who shall fail to correct any defects within ten (10) days after having been notified in writing by the Plumbing Inspector, shall, upon conviction thereof, ~e punished as provided in section 1-7 of the Fairfax City Code. SECTION THREE VALIDITY If any part or parts, section, subsection, sentence, clause or phrase of this Ordinance or of the Code hereby adopted is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance or of the Code hereby adopted. The City Council of the City of Fairfax hereby declares that it would have passed this Ordinance and would have adopted said Code if such unconstitutional part or parts, section, subsection, sentence, clause or phrase had not been included herein. SECTION FOUR DATE OF EFFECT This Ordinance shall be in full force and effect on and after December 20, 1.966. APPENDIX A WAIVER OF JOURNEYMAN'S EXAMINATION Within ninety (90) days from the date of adoption of this Ordinance, any person who can show satisfactory proof to the Board of Plumbing Examiners that he has engaged in the plumbing or gas fitting trade as a Journeyman Plumber or Gas Fitter for a period of two (2) years in the City of Fairfax may have the examination required under Section 16-17 a, waived, and be issued a Journeyman's Certificate by the Board of Plumbing Examiners.
