20040511 r-04-25RESOLUTION R-04-25 RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX SCHOOL BOARD FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE TO ALLOW REDUCTION OF THE REQUIRED PARKING ON THE PREMISES KNOWN AS 3500 OLD LEE HIGHWAY (FAIRFAX HIGH SCHOOL), AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-1-((2))-03. WHEREAS, the City of Fairfax School Board has submitted Application No. SE- 376-04-1 for Special Exception to the City Code section listed below: Section 110-155(b)(2)- Required parking spaces. Off-street spaces shall be provided in accordance with the following minimum standards: Based on a review by the zoning administrator of each proposal including such factors as the occupancy load of all classroom facilities, auditoriums, athletic fields and stadiums, proposed special education programs, student-teacher ratios, and the availability of areas on the site which can be used for auxiliary parking in times of peak demand; but in no instance shall be less than one space for each eight students based on design capacity; plus one space per faculty and staff member and other full-time employee, plus one space for ten seats of auditorium or public assembly facility be provided. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-158 and Section 110-366 for the following reasons: 1. The proposal will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 2. The proposal will not be contrary to the objectives specified in the Comprehensive Plan; 3. The proposal is necessary to permit the reasonable use of the subject property; and 4. Will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of May 2004, that Application No. SE-376-04-1 be and hereby is APPROVED with the following development condition: "The applicant shall not schedule concurrent events in the school's public assembly facilities that would generate parking demand in excess of 901 parking spaces." The motion to adopt the resolution was approved 5-0.
