RESOLUTION TO APPROVE THE REQUEST OF THE UNITED STATES POSTAL
SERVICE, BY JOY ORTIZ, AGENT, THE MARSHALL GROUP, LTD., FOR
RENEWAL OF SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE ON
THE PREMISES KNOWN AS 10660 PAGE AVENUE, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-3-((10))-002.
WHEREAS, the United States Postal Service, by Joy Ortiz, agent, The Marshall Group,
Ltd., has submitted Application No. SE-274-02-2 requesting renewal of a Special
Exception to the following City Code sections:
Section 110-517(3)(a)- to allow a 21-foot front yard on Judicial Drive and a 9 ½ -foot front
yard on Page Avenue, where 25 feet is required.
Section 110-259(a)(1)- to reduce the required landscaping areas and plantings for off-street
surface parking areas on Judicial Drive and Page Avenue.
WHEREAS, City Council has carefully considered the application, the recommendation of
the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal meets the requisites established by the City of Fairfax
Code Sections 110-366, 110-263, and 110-518 for the following reasons:
1. It is generally consistent with the recommendations of the Comprehensive Plan and
the Community Appearance Plan;
2. It is appropriate for the size, shape, and location of the site;
3. It would not have an adverse impact on the existing and planned use and development
of adjacent properties;
4. It would not have an adverse impact on the general public safety and welfare;
5. It is in harmony with the general purpose and intent of the Zoning Ordinance and
Section 15.2-2283 of the Code of Virginia; and
6. It would not result in inadequate on-site amenities or any conditions that would
adversely affect nearby property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 12th day of March, 2002, that Application No. SE-274-02-2 be and hereby is
APPROVED with the following conditions:
The applicant shall increase the width of the proposed utility strip from 3 V2 feet to
four feet along Judicial Drive and Page Avenue.
The applicant shall construct the parking structure predominantly with brick
materials to complement the attached post office building.
The applicant shall work with City staff to revise the plans to provide for an
adequate turnaround area in the public parking area on the northern side of the post
office building. It is understood that such plan revisions may result in the loss of
up to four parking spaces.
The applicant shall install a "Right Turn Only" sign at the Judicial Drive curb cut
for vehicles exiting the site.
The applicant shall install a "Do Not Enter" sign on both sides of the Page Avenue
customer exit to prevent vehicles from entering an exit-only driveway.
On the backside of the "Do Not Enter" signs to be installed at the Page Avenue
customer exit, the applicant shall install a "Left Turn Only" sign and a "Right Turn
Only" sign.

The applicant shall dedicate three feet of right-of-way, which would extend from
the northwestern boundary of the subject property along Judicial Drive to the first
curb cut on Page Avenue, to the City of Fairfax to accommodate the
sidewalk/multipurpose recreational trail and the four-foot utility strip.
The applicant shall establish a conservation easement for the "pan-handle" section
of the subject property, which is located east of the proposed postal facility and
north of the adjacent City Square property, to ensure that no building construction
occurs on that part of the property.
The applicant shall save specified trees according to the Tree Management and
Landscaping Plans, dated February 6, 2002, subject to the Tree Bonding and
Replacement Policy (see Attachment A to the Special Exception Resolution for
Approval with conditions). The exact planting and species of trees shall be
approved by the Board of Architectural Review prior to installation.
The proposed development shall be constructed in substantial conformance with
the Site Layout Plan and architectural elevations, as prepared by The Marshall
Group, Ltd., Architects, dated February 6, 2002. The final design of the proposed
structure shall reflect the extent of architectural articulation and use of building
materials appropriate to Old Town Fairfax. This shall include the use of brick as
the prominent exterior building material for the post office building and the parking
structure. In addition, architectural elements such as colonnades, porticos, arcades,
divided lite windows, arches, decorative quoins, cornices, brick coursing, and
watertables shall be incorporated into the final design, which shall be subject to the
review and approval of the Board of Architectural Review.
During the site plan review and Board of Architectural Review processes, the
applicant shall work with staff to avoid or minimize disturbance to the railroad
embankment and linear railroad feature from construction and landscaping
activities. The applicant shall permit monitoring by archaeological professionals
during landscape installation and in the early construction phases involving
sheeting and shoring of the building and parking lot structure footers to assess and
mitigate potential impacts on the railroad embankment and linear railroad feature
during such activities.

Attachment A
Tree Bonding and Replacement Policy
The applicant shall post a cash bond for the preservation of trees prior to
commencement of construction on the site. At the time of bond release, the trees will
be inspected by the City. If an individual tree exhibits evidence of construction-related
damage, that tree shall remain under bond for at least an additional two years to assess
its prospects for survival and the applicant shall utilize good horticultural practices in
an effort to restore the health of the tree.
Should any existing individual tree shown on the Tree Management and Landscaping
Plans not survive the bonding period due to the impact of construction, the applicant
shall replace such tree as follows:
a) For a tree between five (5) and fifteen (15) inches in diameter breast height (dbh)
failing to survive, two (2) trees with a dbh of not less than three and a half (3 ½)
inches shall be provided;
b) For a tree sixteen (16) inches in dbh or greater failing to survive, three (3) trees
with a dbh of not less than four and a half (4 ½) inches shall be provided.
c) In general, the replacement trees shall be the same species of the failing tree, except
that the applicant may substitute trees of different species with the advice and
consent of the Zoning Administrator.
d) Replacement of trees shall occur: (1) if practical, at the location of tree loss or (2)
elsewhere on site (subject to location approval of the applicant and the City) or (3)
in the event that (1) and (2) above are not practical, off-site on public rights-of-way
along the frontage of the property or in areas beneficial to the property, subject to
approval of the City's Director of Public Works.
e) The applicant shall field-identify the designated trees to be saved according to
their Tree Management and Landscaping Plans for preservation prior to
commencement of clearing and grading and at all times during construction.
Clearing limits around such trees shall be fenced prior to clearing and grading and
at all times during construction. The applicant shall employ other means
reasonably necessary to mitigate the impacts of cleating and grading, including, but
not limited to, flagging, pruning, and fertilization. Further, the applicant shall
designate an individual well-versed in tree preservation to oversee the clearing and
grading activities near the designated trees to be saved and ensure continual
protection of the trees.
