RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX, BY
ROBERT SISSON, CITY MANAGER, FOR A SPECIAL EXCEPTION TO CHAPTER
110 OF THE CITY CODE ON THE PREMISES KNOWN AS 4401 SIDEBURN ROAD,
AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((01))-008.
WHEREAS, the City of Fairfax, by Robert Sisson, City Manager, has submitted
Application No. SE-322-02-1 requesting a Special Exception to Section 110-155 to reduce
the number of required off-street parking spaces to allow 67 parking spaces, where 85 are
required.
WHEREAS, City Council has carefully considered the application, the recommendation of
the staff and testimony received at the public heating; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by the City of Fairfax
Code Sections 110-366 and 110-158 for the following reasons:
1. Is generally consistent with the recommendations of the Comprehensive Plan and other
adopted City goals and policies;
2. Is appropriate for the size, shape, and location of the site;
3. Would not have an adverse impact on the existing and planned use and development of
adjacent properties;
4. Would not have an adverse impact on the general public safety and welfare;
5. Is in harmony with the general purpose and intent of the Zoning Ordinance and Section
15.2-2283 of the Code of Virginia; and
6. Is necessary to permit reasonable use of the property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 14th day of May, 2002, that Application No. SE-322-02-1 be and hereby is
APPROVED, WITH THE FOLLOWING CONDITIONS:

The Special Use Permit and Special Exception approvals for the Main Street Child
Development Center shall expire on May 14, 2004.
The hours of operation for the Main Street Child Development Center shall run
from 6:45 a.m. to 6:15 p.m., with the exception of occasional evening meetings and
classes running until 8 p.m.
The Main Street Child Development Center shall coordinate all evening meetings
and classes with the City of Fairfax Department of Parks and Recreation.
The Main Street Child Development Center shall have no more than 20 employees
on-site at any given time and student enrollment shall not exceed 72.
The City of Fairfax Department of Parks and Recreation shall ensure that
programmed weekday (daytime and evening) and weekend uses of the subject
property do not exceed the available 67 on-site parking spaces and the 29 off-site
parking spaces located on the western side of Sidebum Road.
The City of Fairfax will maintain the play area and fence and will remove the fence
when the Main Street Child Development Center relocates.
The City of Fairfax and Main Street Child Development Center lease will ensure
that there is no loss of play equipment and space for the community.
