20021022 r-02-54 RESOLUTION NO. R-02-54 A RESOLUTION ESTABLISHING A MORATORIUM ON THE CONSIDERATION OF TAX EXEMPTION REQUESTS BY NOT-FOR-PROFIT ORGANIZATIONS WHEREAS, the City Council of the City of Fairfax adopted Resolution R-97-47 stating the policy of the city that "requests for tax exemption are not generally endorsed or encouraged", and WHEREAS, fiscal constraints, both current and projected, facing the City of Fairfax dictate a more cautious policy concerning the consideration of tax-exempt requests by not-for- profit organizations, and WHEREAS, a pending Constitutional amendment referendum may fundamentally change the process for seeking tax exemptions, and WHEREAS, the City Council finds it appropriate to place a moratorium on the consideration of such tax-exempt requests until the city's financial position is clarified; NOW, THEREFORE, be it resolved that: 1. A moratorium on the consideration of tax exempt requests by not-for-profit organizations will be in effect immediately and continue in effect until further notice; 2. Organizations currently enjoying tax exempt status in the City of Fairfax will maintain such status; 3. Organizations who enjoy tax-exempt status by virtue of statutory classification (i.e., churches) are unaffected by this moratorium.
