20010123 r-01-3RESOLUTION NO. R-O 1-3 RESOLUTION TO APPROVE THE REQUEST OF LEE HIGHWAY, LLC, BY STUART D. SCHOOLER, MANAGING MEMBER, FOR SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 10900 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((2))-46 AND 47. WHEREAS, Lee Highway, LLC, by Stuart D. Schooler, Managing Member, has submitted Application No. SE-262-00-1 requesting a Special Exception to the following City Code sections: Section 110-155(b)(3)(g)- to reduce the required number of off-street parking spaces. Section 110-258(a)- to reduce the required transitional screening requirements from the C- 2 (Retail Commercial) to the R,3 (Residential) District. Section 110-259(a)(1)(a) and (b)- to reduce the required landscape area and plantings for off-street surface parking areas. Section 110-259(a)(2)(a, d, e, and f)- to reduce the minimum required parking island dimensions and plantings. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110-366, 110-158, and 110-263 for the following reasons: 1. Is generally consistent with the recommendations of the Comprehensive Plan and the Community Appearance Plan; 2. Is appropriate for the size, shape, and location of the site; 3. Would not have an adverse impact on the existing and planned use and development of adjacent properties; 4. Would not have an adverse impact on the general public safety and welfare; 5. Is in harmony with the general purpose and intent of the Zoning Ordinance and Section 15.2-2283 of the Code of Virginia; 6. Would not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; 7. Is necessary to permit the reasonable use of the property; and 8. Would not result in inadequate on-site amenities or any conditions that would adversely affect nearby property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 23rd day of January, 2001, that Application No. SE-262-00-1 be and hereby is APPROVED with the following conditions: The applicant shall consolidate parcels 46 and 47 prior to site plan approval. The applicant shall provide an access easement to the adjacent eastern property owners for purposes of ingress and egress to the rear of the adjacent eastern site through the eastern side of the subject property (until such time as the footprint of the adjacent building is altered). o o o 10. 11. The applicant shall make a good faith effort to obtain and record a maintenance easement from the adjacent western property owner for the zero-foot side setback. The applicant shall provide a utility easement to the City of Fairfax for the installation of the new water line along the eastern side of the subject property, and shall provide and record water and sanitary sewer easements to encompass the existing lines on the northern boundary of the site. The applicant shall install the requisite plantings on the two parking islands in the rear of the subject property that do not meet the minimum planting island dimensions. The dumpster enclosure shall be constructed of board-on-board materials supported by brick-faced masonry pillars. The proposed landscaping shall consist of evergreen and deciduous trees measuring a minimum of 3 ½ inches in caliper. The proposed shrubs shall measure a minimum of 30 inches in height. On-site lighting shall not exceed 12 feet in height and shall be directed downward and inward to prevent spill light on adjacent property. The proposed development shall be constructed in substantial conformance with the Special Exception Plat, as prepared by Walter L. Phillips, Inc., dated December 8, 2000 and revised through January 10, 2001. The proposed development shall be constructed in substantial conformance with the architectural elevations, as prepared by Cole & Russell Architects, dated October 18, 2000. The applicant shall provide an eight-foot board-on-board fence with brick pillars along the entire rear property line. Adopted this 23rd day of January, 2001. ~~Mayor'~ Attest: (~ty ~lerk
