20010626 r-01-20RESOLUTION NO. 2001 -R-01- 20 RESOLUTION TO APPROVE THE REQUEST OF VENTURA COUNTY EMPLOYEES RETIREMENT ASSOCIATION, BY MARTIN D. WALSH, ATTORNEY-IN-FACT, FOR SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 10300-10398 WlLLARD WAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-2-((20))-004D. WHEREAS, Ventura County Employees Retirement Association, by Martin D. Walsh, Attorney-in-Fact, has submitted Application No. SE-286-01-1 requesting a Special Exception to the following City Code sections: Section 110-180(b)(2)(a): to allow more than one ground-mounted shopping center identification sign, to allow such signage to exceed the maximum permitted square footage, to allow building-mounted tenant signage to exceed the maximum permitted size, and to allow building-mounted tenant signage to be installed in a location other than the building frontage. Section 110-181 (b): to allow ground-mounted signage to exceed the maximum permitted height. WHEREAS, the City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public hearing; and WHEREAS, the City Council has determined that the proposed Special Exceptions are appropriate because the proposals meet the requisites established by City Code Sections 110-185 and 110-366 for the following reasons: o The request meets the criteria established in City Code Section 110-366; The applicant has clearly demonstrated that the signage requirements will present a unique burden due to unusual topography, building design, or lot shape; and The City Council has determined that the granting of special exceptions will not be inconsistent with the Comprehensive Plan or the purpose of the sign regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this twenty-sixth day of June, 2001, that Application No. SE-286-01-1 be and hereby is APPROVED WITH CONDITIONS, as follows: 1. Installation of the signage shall be in substantial conformance with the Courthouse Plaza Signage Program plan prepared by Gallagher & Associates, dated June 13,2001, with the ground-mounted shopping center identification signage modified to reflect a serif lettering style consistent with the Design Guidelines for the Old Town Fairfax Historic and Transition Districts. 2. Installation of the signage shall be done concurrently with the removal of the existing pylon signs located along Old Lee Highway and University Drive. Adopted this 26th day of June, 2001.
