RESOLUTION TO APPROVE, WITH CONDITIONS, THE REQUEST OF
FAIRFAX 123 HOTEL LIMITED PARTNERSHIP BY SHANKER
K.PATEL, MANAGER, AND SHERI HOT, AGENT, FOR SPECIAL
EXCEPTIONS PURSUANT TO CITY CODE SECTION 110-185, FROM CITY
CODE SECTIONS 110-179(A)(1); 110-181(A), TABLE I; AND 110-181(B),
TABLEII.THE APPLICANT IS REQUESTING TO INSTALL GROUND-
MOUNTED AND BUILDING-MOUNTED SIGNAGE THAT EXCEEDS THE
MAXIMUM PERMITTED SIZE AT 3535 CHAIN BRIDGE ROAD, ON THE
PREMISES KNOWN AS TAX MAP PARCEL 47-4-02-002A.
WHEREAS, Fairfax 123 Hotel Limited Partnership by Shanker K. Patel, Manager, and
Sheri Hoy, Agent, has submitted Application No. SE-295-01-1 requesting Special
Exceptions to City Code Sections 110-179 (a) (1); 110-181 (a), Table I; and 110-181 (b),
Table II.
WHEREAS, The City Council has carefully considered the application, the
recommendation of the staff and testimony received at the public hearing; and
WHEREAS, the City Council has determined that the proposed Special
Exceptions are appropriate because the proposals, with conditions, meet the requisites
established by City of Fairfax Code Section 110-366 and 110-185 for the following
reasons:
The request meets the criteria established in City Code Section 110-366.
The applicant has clearly demonstrated that requirements contained in this
division will present a unique burden due to unusual topography, building
design, or lot shape.
The City Council has determined that the granting of special exceptions
will not be inconsistent with the Comprehensive Plan or the purpose of the
sign regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this twenty-fourth day of July, 2001, that Application No. SE-295-01-1 be and
hereby is APPROVED WITH THE FOLLOWING CONDITIONS:
Installation of signage shall be in substantial conformance with the
drawings prepared by Service Neon Signs, Inc. and submitted with the
special exception application.
Prior to installation of the ground-mounted sign described in SE-295-01-1,
the Applicant must execute an agreement to allow the Applicant to
continue to locate the ground-mounted sign in the City's right-of-way, and
to satisfactorily designate maintenance and liability responsibility relating
to the sign.
