R-01-38 RESOLUTION TO APPROVE, WITH MODIFICATIONS AND CONDITIONS, THE REQUEST OF GREENBERG FARROW ARCHITECTS, ENGINEER/AGENT, FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE TO ALLOW ELLMINATION OF THE REQUIRED SEPARATION BETWEEN A STRUCTURE AND ADJACENT DRIVE AISLE AND PARKING SPACES; EXCEED THE MAXIMUM PERMITTED SQUARE FOOTAGE FOR BUILDING-MOUNTED AND GROUND- MOUNTED DIRECTIONAL SIGNAGE AND ALLOW DIRECTIONAL SIGNAGE WITHIN THE REQUIRED SETBACK AREA; EXCEED THE NUMBER OF CONSECUTIVE PARKING SPACES PERMITTED WITHOUT A REQUIRED LANDSCAPED ISLAND AND REDUCE THE WIDTH OF THE REQUIRED PERIPHERAL PARKING LOT LANDSCAPED STRIP; REDUCE THE REQUIRED AMOUNT OF LANDSCAPED OPEN SPACE IN THE C-2 AND C-3 DISTRICTS; AND, ELIMINATE THE REQUIRED TRANSITIONAL LANDSCAPED BUFFER AND SCREENING BETWEEN THE C-3 AND C-2 DISTRICTS AND BETWEEN THE 1-2 AND C-2 DISTRICTS; AND TO REDUCE THE REQUIRED TRANSITIONAL LANDSCAPED BUFFER BETWEEN THE 1-2 AND 1-2 DISTRICTS ON THE PREMISES KNOWN AS 3201 OLD LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-((2))-014. WHEREAS, Greenberg Farrow Architects has submitted Application No. SE-306-01- 1 requesting Special Exceptions to the City Code as listed below: Section 110-153(3) - to allow elimination of the required four-foot-wide separation between a drive aisle and structure, and elimination of the required six-foot-wide separation between parking spaces and a structure. Section 110-181 (a) & (b) - to allow building-mounted signage that exceeds the maximum permitted square footage, and to allow two new ground-mounted signs that exceed the maximum permitted square footage and are located within the required 25-foot front setback area and 1 O-foot side setback area, and to allow the existing pylon sign to remain. Section 110-259(a)- to allow more than 12 consecutive parking spaces without an intermittent planting island and to reduce the width of the peripheral parking lot landscaping strip where the minimum requirement is a seven-foot-wide strip. Section 110-783(4)- to allow 10% landscaped open space where 25% is required in the C-2 (Retail Commercial) District. Section 110-803(4)- to eliminate the required 20% landscaped open space in the C-3 (General Commercial) District. Section 110-258 - to eliminate the required 25-foot-wide landscaped strip and screening between the C-3 and C-2 Districts, and between the 1-2 (Industrial) and C-2 Districts and to reduce the required 25-foot-wide landscaped strip between the 1-2 and 1-2 Districts. WHEREAS, City Council has determined that the proposed Special Exceptions, with modifications and conditions, are appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 110-366, 110-158, 110-185, 110-263, 110- 783(6), and 110-803(6) for the following reasons: o Will not be contrary to the objectives specified in the Comprehensive Plan. Will not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; Is necessary to permit the reasonable use of the subject property; Will not result in inadequate on-site amenity; and Will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of December, 2001, that Application No. SE-306-01-1 be and hereby is APPROVED, with the following modifications and conditions: Development shall be consistent with the Special Exception Plan dated November 12, 2001, and revised through December 3, 2001, with modifications to include a brick pier on each end of the proposed board-on-board fence (along the east property line) and evergreen shrubs planted between the trees from the end of the fence to Old Pickett Road. Development shall be consistent with the architectural elevations dated December 4, 2001 and the applicant shall ensure that the proposed fence will be constructed of an ornamental metal railing consistent with the attached photograph. o The applicant shall work with the owner of Tax Map parcel 48-3-((2))-14A to ensure that parking lost due to the garden center expansion does not adversely impact Parcel 14A. If necessary, required parking tbr Parcel 14A shall be provided off-site on Parcel 14. In order to resolve this issue, parking dedicated to the Home Depot use may be reduced from the 513 parking spaces shown on the Special Exception Plan to a lesser number subject to review and approval by the Zoning Administrator, provided a minimum of 471 parking spaces are provided as required by City Code. The applicant shall ensure that the proposed fence for the garden center (shown in the oblique view on the front elevation) will be designed to screen the view of all garden center merchandise, stock, supplies or equipment that would be stored in high stacks against the garden center fence and would be visible from the main parking area. o The applicant shall ensure that shopping carts are properly corralled in an area near the main entrance that does not block the drive aisles, parking spaces or fire lanes. o The applicant shall provide pavement striping and signage that prohibits parking along the side of the tool center storage area that is adjacent to the parking lot. o Total building-mounted signage shall not exceed the maximum permitted by City Code. ° The existing pylon sign shall be removed within six months from the date of approval of the resolution. Adopted this 11th day of December, 2001. The motion to adopt the resolution was approved 6-0.
