RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX RACQUET CLUB, 1NC.,
BY DAVID S. HOUSTON, ATTORNEY/AGENT, FOR A SPECIAL EXCEPTION TO
CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 9858, 9860,
AND 9870 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX
MAP PARCELS 48-3-((2))-2, 2A, 3, AND 4C.
WHEREAS, Fairfax Racquet Club, Inc., by David S. Houston, Attorney/Agent, has
submitted Application No. SE-259-00-1 requesting a Special Exception to the City Code
sections listed below:
Sections 26-173(d) and (e)- to reduce the required open space and FAR.
Section 26-65(a)- to reduce the required tree canopy.
Section 26-69(a)(1)- to reduce the required landscaping areas and plantings for off-street
surface parking areas.
Section 26-68(a)- to reduce the required screening requirements from the 1-2 (Industrial) to
the C-2 (Retail Commercial) districts.
Section 26-19.1 (b)(2)- to enlarge a building located in the Resource Protection Area.
Section 26-39.5(b)(3)- to reduce the number of required off-street loading spaces.
WHEREAS, City Council has carefully considered the application, the recommendation of
the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by the City of Fairfax
Code Sections 26-103, 26-19.3, 26-39.7, 26-71.2, and 26-173(0 for the following reasons:
1. It is generally consistent with the recommendations of the Comprehensive Plan;
2. It is appropriate for the size, shape, and location of the site;
3. It would not have any adverse impact on the existing and planned use and
development of adjacent properties;
4. It would not have an adverse impact on the general public safety and welfare;
5. It is in harmony with the general purpose and intent of the Zoning Ordinance and
Section 15.2-2283 of the Code of Virginia;
6. It would not result in increased traffic congestion or otherwise negatively impact
existing traffic flow or pedestrian and vehicular safety;
7. It is necessary to permit reasonable use of the property;
8. It is consistent with the Community Appearance Plan;
9. It is reasonably consistent with the Tree Preservation, Landscaping and Screening
Division of the Zoning Ordinance;
10. It would not overburden the existing or available community facilities;
11. It would not result in the obstruction of light and air, danger and congestion in
transportation, or increased danger from fire, flood, or other hazards; and
12. It would not result in a development which is disproportionate to surrounding land
uses in size, bulk, or scale.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 11th day of July, 2000, that Application No. SE-259-00-1 be and hereby is
APPROVED with the following conditions:
The applicant shall remove the existing pylon sign located on the eastern side of
the subject property adjacent to Lee Highway.

The applicant shall install a minimum 30-inch evergreen hedge and 3.5-inch
caliper deciduous trees in the required parking lot landscaped strip adjacent to Lee
Highway, subject to site plan review and approval.
The applicant shall grant and record an access easement across Tax Map Parcel
48-3-((2))-3 to the City of Fairfax for purposes of ingress and egress prior to site
plan approval.
Upon taking ownership of Tax Map Parcels 48-3-((2))-2A and 3, the applicant
shall consolidate these parcels with Tax Map Parcel 48-3-((2))-2.
The proposed addition shall be constructed in substantial conformance with the
Special Use Permit/Special Exception Plat, as prepared by Patton, Harris, Rust &
Associates, P.C., dated May 3, 2000 and revised through July 3, 2000.
Adopted this 11th day of July, 2000.
