RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIRFAX
SCHOOL BOARD BY JOHN H. RUST, AGENT, FOR A SPECIAL
EXCEPTION TO ALLOW AN EXTERNALLY ILLUMINATED SIGN
WITHIN ONE HUNDRED FEET (100') OF A RESIDENTIAL DISTRICT ON
THE PREMISES KNOWN AS 3710 BEVAN DRIVE, AND MORE
PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-5A.
WHEREAS, the City of Fairfax School Board through John H. Rust, Agent, has
submitted Application No. SE-256-00-1 requesting a Special Exception to City Code
Section 26-43(b)(2); and
WHEREAS, the City Council has carefully considered the application, the
recommendation of the staff, and testimony received at the public heating; and
WHEREAS, the City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City Code Section 26-
103(c) for the following reasons:

The proposed illuminated sign is consistent with the Comprehensive Plan;
The size and shape of the lot are adequate to accommodate sign;
Vehicular and pedestrian traffic would be facilitated, rather than impeded by placement of a
sign;
The proposed sign would serve to heighten visibility of the entrance to the rear of the school.
It would not encourage more trips to and from the area;
The site of the proposed sign is adequate to accommodate a sign of the intended proportions
allowing for the necessary ten foot (10') setback requirements for the right-of-way;
Noise, traffic, smoke, dust, odor and vibration would be minimal factors in erection of this
sign. Lighting and sight factors would minimally impact the serenity of neighboring
communities;
In clearly marking the entrance to the rear of the school, the safety and movement of
vehicular traffic would be enhanced by placement of a sign;
The safety and welfare of residents living in the area is likely to be enhanced by improving
visibility of the entrance to Russell Auditorium;
The location, height and design of the sign meet City Code requirements;
Development and use of adjacent land is unlikely to be affected by placement of this sign;
The clear marking of the rear entrance to Lanier Intermediate School is likely to enhance the
safety and welfare of persons working in the neighborhood;
Compliance with the Zoning Ordinance that no illuminated sign may be erected within 100'
of a residential district would pose an unique burden on motorists trying to locate Russell
Auditorium;
The illuminated sign at the rear entrance to Lanier Intermediate School meets the criteria set
forth in City Code, and hence the Code of Virginia, for a permissible special exception.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 25th day of July, 2000 that Application No. SE-256-00-1 be and hereby is
APPROVED.
